Judgments In Motions Filed by The Trustee


The trustee filed to the insolvency court a motion for instructions (claim) against Mrs. Hila Lotan, in which the trustee argued that Mrs. Lotan is required to return to the creditors’ pool funds in the amount of 100,000 NIS and 50,000 USD that the debtor transferred to her shortly after the opening of proceedings insolvency. After pleadings and affidavits were submitted, after a hearing on the request was held in court (in the framework of which the trustee deposed Mrs. Lotan in a cross-examination), and after summaries were submitted, on January 27, 2021, a judgment was given by the court against Mrs. Lotan according to which Ms. Lotan was ordered to return and pay to the creditors’ pool a sum of 59,600 NIS (plus linkage differences and interest from May 5, 2021); A total of 50,000 USD (plus linkage differences and interest from June 7, 2021, according to the dollar rate at that time); and a total of 35,000 NIS for the expenses of the motion.


The trustee filed to the insolvency court a motion for instructions (claim) against Mrs. Vered Ben Ari, the debtor’s divorcee, in which the trustee argued that Mrs. Vered Ben Ari is required to return to the creditors’ pool funds transferred to her from the EGFE Israel (in liquidation) during a period of three months prior to the issuance of the order to open insolvency proceedings in the amount of 58,900 USD and 496,313 NIS. After pleadings and affidavits were submitted, after a hearing was held in court (in the framework of which the trustee deposed Mrs. Ben Ari in a cross-examination), and after summaries were submitted, on June 12, 2022, a judgment was given by the court against Mrs. Ben Ari according to which Mrs. Ben Ari was ordered to return and pay 300,000 NIS to creditors’ pool (plus linkage differences and interest from February 28, 2021) as well as 35,000 NIS for the expenses of the motion.


The trustee filed to the insolvency court a motion for instructions (claim) against Mr. Meir Eini, in which the trustee argued that Mr. Eini is required to return to the creditors’ pool funds transferred to him as a bullet loan in the amount of 400,000 USD. After pleadings and affidavits were submitted, after a hearing was held in court (in the framework of which the trustee deposed Mr. Eini in a cross-examination), and after summaries were submitted, on July 20, 2022, a judgment was given by the court against Mr. Eini according to which Mr. Eini was ordered to return and pay 400,000 USD to creditors’ pool (according to the USD rate on the bullet loan repayment date – January 1, 2020), as well as 50,000 NIS for the expenses of the motion.


The trustee filed to the insolvency court a motion for instructions (claim) against Mr. Shaham, in which the trustee argued that Mr. Shaham is required to return to the creditors’ pool funds transferred to him shortly after the opening of proceedings insolvency in the amount of 50,000 USD. After pleadings and affidavits were submitted, a hearing was held in court on January 26, 2022, during which Mr. Shaham agreed to return and pay to the creditors’ pool the amount of 50,000 USD, as requested by the trustee in the motion.


The trustee filed to the insolvency court a motion for instructions (claim) against Mr. Gal [together with Mr. Shmuel Avivi, in whose case a settlement agreement was later approved by the court] in which the trustee argued that Mr. Gal is required to return to the creditors’ pool funds transferred to him shortly after the opening of proceedings insolvency in the amount of 700,000 USD. Mr. Gal did not submit a statement of defense on his behalf. On June 26, 2022, a judgment was given against Mr. Gal in the absence of defense according to which Mr. Gal was ordered to return and pay to the creditors’ pool the amount of 570,000 US dollars [which is the difference between the amount claimed and the amount received as part of the settlement agreement with Mr. Avivi] and 15,000 NIS for the expenses of the motion.
